tread cautiously when considering ejido land To start with, you cannot purchase Ejido Land. If you know that up front, it will keep you from starting down the path of purchasing land which probably cannot be purchased “today”. Ejido Land, by definition is land which is registered with the Agrarian Ministry in México. This registry system is separate from the Public Recorder’s system and has the obligation of keeping track of all ejido land in the specific state and also to oversee the privatization process. The privatization of ejido land is the legal process by which ejido land can be converted into public land. When the privatization process has been completed, the land will be transferred out of the Agrarian system and registered in the Public Recorder’s system. Please know that this privatization process is very black and white with no room for mistakes. Mistakes can cause title related defects against the property down the road and thus it is very important that this process is done exactly right. If you are even considering land that is registered with the agrarian ministry, please take a step back and contact our office. First Title Services can perform a Preliminary Title Report (Prelim) on the property to verify the specific legal status of the property. If you are serious about acquiring the subject property, our attorneys will provide the necessary consulting to properly advise you through the process. Our clients that purchase ex-ejido land are not your typical buyers and are typically much more educated in the real estate process here in México. First Title Services knows the process to privatize Ejido land and has been involved in many files dealing with Ejido land. Please know that if our attorneys are not able to prove that everything was done as required by law to privatize the land, then your transaction may not be insurable with Title Insurance. We would recommend that you come and spend some time with us before you start to get interested in ejido property. |
